Pursuant to the Professionals Direct insurance policy, a claim is defined as: "...a demand or suit for money or services received by the Insured, including any arbitration proceedings to which the Insured is required to submit or to which the Insured has submitted with the company's consent; or when any insured first received information or has knowledge or specific circumstances involving a particular person or entity which could reasonably be expected to result in a demand or suit for money or services." When a circumstance arises that does or is reasonably foreseeable to fall within the above definition, we encourage you to contact the Claims Department to discuss the matter.
When is a Claim First Made Against an Insured?
The Professionals Direct insurance policy states that: "A claim is first made against an Insured at the earlier of the following:
- When the Insured first receives written notice that a claim has been made; or
- When the Insured first receives information or has knowledge of specific circumstances involving a particular person or entity which could reasonably be expected to result in a claim.
The key to knowing when to report a claim is to report any fact or circumstance which would lead a reasonable person to believe that a malpractice claim may be made. Th s is true even if you believe the claim would be utterly without merit, or could not be won due to some legal or factual issue. Additionally, you MUST IMMEDIATELY report any suit filed against you, any grievance filed against you, and any written demand submitted to you.
